Sharpen Up DTT, LLC

By signing this Media Release and Consent Form, the undersigned participant (or, in the case of a minor, the parent or legal guardian signing on the minor’s behalf) hereby grants consent for photography, videography, and audio recording of the participant at all Sharpen Up DTT, LLC events, classes, rehearsals, performances, workshops, recitals, competitions, and related activities. Where the participant is a minor, all references in this Form to consent, releases, representations, waivers, and acknowledgments made by “the participant” or “the undersigned” shall be deemed to be made by the parent or legal guardian on the minor’s behalf.
The undersigned hereby grants to Sharpen Up DTT, LLC, its affiliates, successors, and assigns a perpetual, irrevocable, worldwide, non-exclusive license to use, reproduce, modify, distribute, and display any images, video, and audio recordings of the participant for the following purposes:
The undersigned (or, where the participant is a minor, the parent or legal guardian on the minor’s behalf) hereby releases Sharpen Up DTT, LLC, its owners, employees, agents, and representatives from any and all claims related to the use of the participant’s likeness, image, voice, or appearance, including but not limited to claims for invasion of privacy, defamation, or right of publicity.
The undersigned (or, where the participant is a minor, the parent or legal guardian on the minor’s behalf) waives any right to inspect or approve the finished product, including written or electronic copy, photographs, video, or audio recordings in which the participant’s likeness appears.
The undersigned (or, where the participant is a minor, the parent or legal guardian on the minor’s behalf) acknowledges that images, video, and audio recordings may be altered, cropped, edited, combined with other materials, or otherwise modified at the sole discretion of Sharpen Up DTT, LLC.
The undersigned (or, where the participant is a minor, the parent or legal guardian on the minor’s behalf) acknowledges and agrees that no royalty, fee, or other compensation shall be payable to the participant for the use of any images, video, or audio recordings, whether now or in the future. The undersigned (or parent or legal guardian, as applicable) waives any right to compensation arising from or related to the use of such materials.
Given the nature of dance instruction and the participation of minors in Sharpen Up DTT, LLC programs, the following provisions apply specifically to participants under the age of eighteen (18):
Parental or legal guardian consent is required for ALL participants under the age of eighteen (18). No images, video, or audio recordings of a minor will be used for any purpose described in this release without the express written consent of the minor’s parent or legal guardian. It is the parent or legal guardian — not the minor — who grants consent, executes this release, and accepts its terms on the minor’s behalf.
By signing this release, the parent or legal guardian represents and warrants that: (a) they have full legal authority to grant consent and execute this release on the minor’s behalf; (b) no other parent, guardian, or person with legal custody has objected to or restricted such consent; and (c) the parent or legal guardian is the sole party granting consent, making representations, and accepting the terms of this release on behalf of the minor.
The parent or legal guardian specifically acknowledges and accepts, on the minor’s behalf, that the minor’s image, video, or audio recording may appear on the internet and social media platforms that are accessible worldwide. Once published online, such content may be shared, downloaded, or redistributed by third parties beyond the control of Sharpen Up DTT, LLC.
For participants under the age of thirteen (13), the following additional provisions apply in accordance with the Children’s Online Privacy Protection Act (COPPA). By executing this Media Release and Consent Form, the parent or legal guardian provides verifiable parental consent as required by COPPA for the collection, use, and publication of the child’s image, video, or audio recording. This signed release shall constitute verifiable parental consent for all purposes under COPPA and applicable regulations. All consent for use of a child’s image, video, or audio recording under this section must be provided exclusively by the child’s parent or legal guardian:
The participant (or parent/legal guardian of a minor participant) may revoke this consent at any time by providing written notice to Sharpen Up DTT, LLC at the following email address:

The following conditions apply to any revocation of consent:
Revocation of media consent by a parent or legal guardian of a minor participant may, at the sole discretion of Sharpen Up DTT, LLC, be treated as an effective termination of all purchases, subscriptions, event registrations, and services associated with the minor participant. Due to the substantial and overbearing administrative burden of identifying and removing specific individuals from photographs, videos, and other media produced during events, classes, and activities, Sharpen Up DTT, LLC may determine that continued provision of services to the minor is not reasonably practicable following revocation of media consent. In such event, Sharpen Up DTT, LLC shall provide written notice to the parent or legal guardian that the minor’s participation and access to all services will be terminated, effective as of the date of such notice or the effective date of revocation, whichever is later. No refunds, credits, or other compensation shall be due as a result of such termination, and the terms of the applicable Refund Policy and Terms and Conditions shall govern.
Sharpen Up DTT, LLC is committed to protecting the privacy of all participants. The following data protection measures apply to all images, video, and audio recordings collected under this release:
This Media Release and Consent Form shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflicts of law principles. Any disputes arising under or in connection with this release shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
If any provision of this Media Release and Consent Form is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
By signing below, the undersigned acknowledges that they have read, understood, and agree to the terms of this Media Release and Consent Form. Where the participant is a minor, the parent or legal guardian confirms that they are executing this release and granting all consents contained herein on the minor’s behalf. The undersigned further acknowledges that this consent is given voluntarily and without coercion.
